NOTICE OF SPECIAL ELECTION

            PLEASE TAKE NOTICE that on Tuesday, November 4, 2014, there will be conducted a Special Election at which the voters of Lee County will be asked if they approve or disapprove of the adoption of Amendments to the Lee County Charter to become effective, if approved, on January 1, 2015. This form of the ballot will read substantially as follows:

            The election will be conducted between the hours of 7:00 a.m. and 7:00 p.m. All duly registered voters of Lee County may participate in the election. A copy of this Notice and a copy of the proposed Amendments are on file in the Office of the Clerk of the Circuit Court of Lee County, Florida, Minutes Office. The public may inspect or copy the proposed amendments during regular business hours at the Office of Public Resources. The Minutes Office and Public Resources are located in the Courthouse Administration Building, 2115 Second Street, Fort Myers, Florida. Public Resources is located on the first floor and the Minutes Office is located on the second floor of the Courthouse Administration Building.

 

            Information concerning voter registration and precinct locations may be obtained from the Office of the Supervisor of Elections, Lee County Constitutional Complex, 2480 Thompson Street, Fort Myers, Florida. Phone: (239) 533-8683.

AMENDMENT TO LEE COUNTY CHARTER

 

 

 

            Title:                 County Charter Revision relating to setting the number of consecutive terms of the Board of County Commissioners.

 

 

 

Summary:         County Charter Amendment Section 2.2.A “Legislative Branch The County Commission”; limiting the number of consecutive terms of the Board of County Commissioners; amendment would limit County Commissioners to serving no more than three (3) consecutive four-year terms in office excluding terms of service prior to January 1, 2015.

TENGA A BIEN SABER que el martes 4 de noviembre de 2014 se realizarán unas Elecciones  Extraordinarias, en las que le preguntarán a los electores del Condado de Lee si aprueban o rechazan la adopción de las Enmiendas a la Constitución del Condado Lee que, si son aprobadas, entrarán en vigor el 1ro  de enero de 2015. Esta forma de la boleta expresará esencialmente lo siguiente:

Las elecciones se realizarán en el horario comprendido entre las 7:00 a.m. y las 7:00 p.m. Todos los electores debidamente inscritos del Condado de Lee pueden participar en estas elecciones. Una copia del presente aviso y una copia de las enmiendas propuestas constan en los archivos de la Secretaría del Tribunal de Circuito del Condado de Lee, Florida, Oficina de Actas. El público puede inspeccionar o copiar las enmiendas propuestas durante las horas normales de trabajo en la Oficina de Recursos Públicos. La Oficina de Actas y Recursos Públicos se encuentran situadas en el Edificio Administrativo del Tribunal de Justicia en 2115 Second Street, Fort Myers, FL. Recursos Públicos está situada en el primer piso y la Oficina de Actas está situada en el segundo piso del Edificio Administrativo del Tribunal de Justicia.

ENMIENDA A LA CONSTITUCIÓN DEL CONDADO DE LEE

 

 

            Título:               Revisión de la Constitución del Condado relacionada con el establecimiento del número de períodos consecutivos de la Junta de Comisionados del Condado.  

 

 

 

Resumen:         Enmienda del Artículo 2.2.A “Poder legislativo: La Comisión del Condado”  de la Constitución del Condado que limita el número de períodos consecutivos de la Junta de Comisionados del Condado; la enmienda limitaría a los comisionados del condado a ejercer no más de tres (3) mandatos consecutivos de cuatro años en el cargo, excluyendo los mandatos ejercidos antes del 1ro de enero de 2015.

            TENGA A BIEN SABER  que el martes 4 de noviembre de 2014 se convoca por este medio a unas elecciones por referéndum, con el objetivo de someter a los electores aptos que residen dentro de los límites corporativos propuestos de la propuesta Villa de Estero, tal como se describe en el Artículo 3 de HB 1373, la cuestión según —se expone en el artículo 12 de dicha Ley— acerca de la aprobación de dicha ley que crea la Villa de Estero y establece su Constitución.

 

            Dicho referéndum se deberá realizar según autoriza CS/CS/HB 1373, inscrito, con unas elecciones de conformidad con el Código de Elecciones de Florida tal como se reforme de tiempo en tiempo.

 

            Según se aprobó por el Artículo 12 de CS/CS/HB 1373, inscrito, la cuestión sometida en la boleta se leerá sustancialmente de la forma siguiente:

NOTICE BY LEE COUNTY BOARD OF COUNTY COMMISSIONERS OF INTENT TO USE THE UNIFORM AD VALOREM METHOD OF COLLECTION OF A NON-AD VALOREM ASSESSMENT

Notice is hereby given to all owners of lands located within the boundaries of the CHERRY ESTATES CIP ROAD MSBU that Lee County Government intends to use the uniform method of collecting non-ad valorem special assessments within the unincorporated area of Lee County levied by the Lee County Board of County Commissioners as set forth in §197.3632, Florida Statutes, and that the Board of County Commissioners will hold a public hearing on Tuesday, the 2nd day of December, 2014, at 9:30 a.m., or as soon thereafter as may be heard, in the Board Chambers of the Old Courthouse, 2120 Main Street, Fort Myers, Florida. The purpose of the public hearing is to consider the adoption of a Resolution for the first time commencing Fiscal Year October 1, 2015, and annually thereafter authorizing Lee County Government to use the uniform ad valorem method of collecting non-ad valorem assessments levied by the Lee County Board of County Commissioners as provided in §197.3632, Florida Statutes. Such Resolutions will state the need for the levy and will contain a legal description of the boundaries of the real property subject to the levy. Copies of the proposed resolution, which contain the legal descriptions of the real property subject to the levy, are on file at the office of the Minutes Department and Public Resources, both located at 2115 Second Street, Fort Myers, Florida. All interested parties may appear at the public hearing to be heard regarding the use of the uniform ad valorem method of collecting such non-ad valorem assessments. If any person decides to appeal any decision by the Board with respect to any matter considered at this public hearing such person will need a record of proceedings and for such purpose such person may need to ensure that a verbatim record of the proceedings is made at their own expense and which record includes the testimony and evidence on which the appeal is based. In accordance with the Americans with Disabilities Act, persons needing a special accommodation or an interpreter to participate in this proceeding should contact Lee County Public Resources at (239) 533-2737 at least seven days prior to the date of the hearing.
