NOTICE OF PUBLIC HEARING

            PLEASE BE ADVISED that on the 3rd day of November, 2009, at 9:30 A.M., or as soon thereafter as possible, in the County Commissioner’s Meeting Room, Old Lee County Courthouse, 2120 Main Street, Fort Myers, Florida, the Board of County Commissioners of Lee County, Florida will consider and take action on the adoption of a Resolution authorizing the exchange of public property for other real property pursuant to Section 125.37 of the Florida Statutes.

                                                                                   

            The public property to be exchanged is Lee County’s real property interest in a public utility easement being more particularly described as follows:

 

            A parcel of land lying in the State of Florida, County of Lee, in Section 19, Township 46 South, Range 24 East, part of government lot 4 as recorded in Official Records Book 3792, Page 3380 of the Public Records of Lee County, Florida and being more particularly described as follows:

 

            Commencing at the intersection of the easterly line of said government lot 4 and the southwesterly right-of-way line of Main Street, a county road 50 feet in width, as described in Deed Book 137 at Page 117 of the Public Records of Lee County, Florida; thence S.00˚00’00”E along said easterly line of said government lot 4, a distance of 157.80 feet to the point of beginning; thence continue S.00˚00’00”E along said easterly line of said government lot 4, a distance of 232.20 feet; thence S.90˚00’00”W, a distance of 20.00 feet; thence N.00˚00’00”W, a distance of 212.01 feet; thence N.44˚43’34”E, a distance of 28.42 feet to the point of beginning.

 

            Containing 4,442 square feet, more or less.

 

            The property to be received by Lee County in exchange is a real property interest described as:

 

            A parcel of land lying in the State of Florida, County of Lee, in Section 19, Township 46 South, Range 24 East, part of government lot 4 as recorded in Official Records Book 3792, Page 3380 of the Public Records of Lee County, Florida and being more particularly described as follows:

 

            Commencing at the intersection of the easterly line of said government lot 4 and the southwesterly right-of-way line of Main Street, a county road 50 feet in width, as described in Deed Book 137 at Page 117 of the Public Records of Lee County, Florida; thence S.00˚00’00”E along said easterly line of said government lot 4, a distance of 157.80 feet; thence S.44˚43’34”W, a distance of 28.43 feet to the point of beginning; thence S.00˚00’00”E, a distance of 209.13 feet; thence S.90˚00’00”W, a distance of 49.00 feet; thence N.00˚00’00”W, a distance of 20.00 feet; thence N.90˚00’00”E, a distance of 29.00 feet; thence N.00˚00’00”W, a distance of 197.36 feet; thence N.44˚43’34”E, a distance of 28.42 feet; thence S.00˚00’00”E, a distance of 28.42 feet to the point of beginning.

 

            Containing 5,129 square feet, more or less.

 

            The terms will be the exchange of the County’s property interest in a public utility easement in return for Lee County receiving a replacement public utility easement in two parcels.  The property owner will be responsible for all costs of effecting the exchange, including all costs of permitting and construction of the replacement utility easement.  An agreement is requested to be adopted to further delineate the obligations of the property owner in effecting the exchange.

 

            Parties to the exchange will be the Key West Express, LLC, a Florida limited liability company and Lee County, Florida.  If the Resolution of Exchange is adopted, the closing of said exchange will follow thereafter in accordance with the terms of the approved Resolution and attached agreement therein.
