VACATE

TO WHOM IT MAY CONCERN:
 NOTICE is hereby given that on the 9th day of February, 2010 at 9:30AM in  the County Commissioners’ Meeting Room. Old Lee County Courthouse, 2120 Main Street, Fort Myers, Florida, the Board of County Commissioners of Lee County, Florida, will consider and take action on a Petition vacating, abandoning, closing and discontinuing the public’s interest in the right-of-way or portion of a right-of-way, legally described as follows:
 A parcel of land situated in the State of Florida, County of Lee, Section 15, Township 45 South, Range 24 East, being a portion of Winkler Road right-of-way as described in Deed Book 323 at Page 180, lying within Lot 1, Wildwood Hammock Professional Park, a subdivision recorded in Plat Book 50 at Page 95, Public Records of Lee County, Florida, and further described as follows:
 Beginning at the southeast corner of said Lot 1; thence S89°01’42”W along the south line of said Lot 1 for 22.38 feet to the west line of said deeded Winkler Road right-of-way; thence N01°13’48”W along said west line for 172.26 feet to the north line of said Lot 1 being on a curve concave to the northeast having a radius of 67.50 feet and to which point a radial line bears S25°05’37”W; thence southeasterly along said curve and the north line of said Lot 1 through a central angle of 24°28’03” (chord bearing S77°08’24”E) for 28.83 feet to the east line of said Lot 1, being the west line of the maintained right-of-way line of Winkler Road; thence S00°37’38”W along said maintained right-of-way line for 165.48 feet to the Point of Beginning.
 Containing 4,212 square feet, more or less.
 Bearings are based on the State Plane Coordinate System (Florida West Zone - North American Datum of 1983/1990 Adjustment) with the south line of the Southwest One Quarter (SW 1/4) of Section 22 as bearing S89°01’42”W.
 A parcel of land situated in the State of Florida, County of Lee, Section 15, Township 45 South, Range 24 East, being a portion of Winkler Road right-of-way as described in Deed Book 323 at Page 180 lying within Lot 2, Wildwood Hammock Professional Park, a subdivision recorded in Plat Book 50 at Page 95, Public Records of Lee County, Florida, and further described as follows:
 Beginning at the northeast corner of said Lot 2, said point lying on the west line of the maintained right-of-way line of Winkler Road; thence S89°04’31”W along the north line of said Lot 2 for 37.48 feet to the west line of said deeded Winkler Road right-of-way; thence S01°13’48”E along said west line for 246.12 feet to the south line of said Lot 2 being on a curve concave to the southwest having a radius of 80.16 feet and to which point a radial line bears N57°06’55”E; thence continue southeasterly along said curve and said south line through a central angle of 2°16’21" (chord bearing S31°44’55"E) for 3.18 feet to the beginning of a reverse curve concave to the northeast having a radius of 32.50 feet; thence continue along said curve and said south line through a central angle of 58°45’38” (chord bearing S59°59’34”E) for 33.33 feet to the southeast corner of said Lot 2, being on the aforesaid maintained right-of-way line of Winkler Road; thence N00°37’38”E along the east line of said Lot 2 and said maintained right- of-way line for 265.33 feet to the Point of Beginning
Containing 8,639 square feet, more or less.
Bearings are based on the State Plane Coordinate System (Florida West Zone - North American Datum of 1983/1990 Adjustment) with the south line of the Southwest One Quarter (SW 1/4) of Section 22 as bearing S89°01’42"W.

 Commencing at the southeast corner of Lot 1, said Wildwood Hammock Professional Park, said point lying on the west line of the maintained right-of-way line of Winkler Road; thence N00°37’38”E along the east line of said Lot 1 and said maintained right-of-way line for 165.48 feet to the northeast corner of said Lot 1 and the Point of Beginning; thence continue N00°37'38”E along said maintained right-of-way line and the east line of said Tract I for 35.00 feet to the northeast corner of said Tract I and an intersection with a curve concave to the northeast having a radius of 32.50 feet and to which point a radial line bears S00°37’38”W; thence continue northwesterly along said curve and the north line of said Tract I through a central angle of 58°45’38” (chord bearing N59°59'34”W) for 33.33 feet to the beginning of a reverse curve  concave to the southwest having a radius of 80.16 feet; thence continue northwesterly along said curve and the said north line of Tract I through a central angle of 2°16’21" (chord bearing N31°44’55"W) for 3.18 feet to the west line of said deeded Winkler Road right-of-way; thence S01°13'48”E along said west line for 47.29 feet to the south line of said Tract I being on a curve concave to the northeast having a radius of 67.50 feet and to which point a radial line bears S25°05’37"W; thence continue southeasterly along said curve and said south line of Tract I through a central angle of 24°28’03” (chord bearing S77°08’24”E) for 28.83 feet to the Point of Beginning.
Containing 1,087 square feet, more or less.
Bearings are based on the State Plane Coordinate System (Florida West Zone - North American Datum of 1983/1990 Adjustment) with the south line of the Southwest One Quarter (SW 1/4) of Section 22 as bearing S89°01’42”W.
 Interested parties may appear in person or through a representative and be heard with respect to the Petition to Vacate.
Anyone wishing to appeal the decision made by the Board with respect to any matter considered at this meeting will need a record of the proceeding for such appeal, and may need a verbatim record, to include all testimony and evidence upon which the appeal is to be based
